All work is carried out by Photos2Stitch on the understanding that the customer has agreed to the following Terms and Conditions which relate to all products and services supplied by Photos2Stitch.
Indemnity
Customers and other users of this website agree to indemnify the company against any claims, direct, indirect or consequential damage, loss or expense that may be caused as a direct or indirect result of the use of this website and any information or computer software contained therein or by your access to other websites as a result of links from this site. We make every effort to ensure that this website does not contain any computer viruses but cannot guarantee this or warrant that it is virus-free.
Pricing
We endeavour to ensure that all published prices are correct. However, we reserve the right to change prices without notice and not to accept orders at prices that have been quoted in error. Prices are quoted in pounds.
Disclaimer
Photos2Stitch makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Photos2Stitch will not be held responsible for any and all damages resulting from products and/or services it supplies. Photos2Stitch is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. While we take reasonable steps to investigate the materials we supply, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Photos2Stitch responsible for any such loss or damage. Any claim against Photos2Stitch shall be limited to the relevant fee(s) paid by the customer. All disputes arising out of, or in connection with, any contract between the company and the buyer shall be governed by English Law and the buyer accepts the jurisdiction of the English courts.
Security and privacy
We respect your right to privacy and ensure that all transactions are made in accordance with our privacy policy. We comply with the provisions of the Data Protection Act (1998) and the European Union Data Protection Framework Directives and only store data necessary for accounting, marketing, sales, public relations and record keeping in order to maintain and improve the trading relationship between the company and its customers and suppliers. We do not sell, loan or rent data to any other party.
Payment Security
All credit card payments made during on-line transactions are handled on our behalf by the PayPal payment gateway. No credit card details are processed or stored at any time on the company’s website.
Copyrights and Trademarks
The customer declares that it holds the appropriate copyright and/or trademark permissions for any text, images or other data supplied to Photos2Stitch by customers or third parties for inclusion in any medium. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner. By supplying images, text, or any other data to Photos2Stitch, the customer grants Photos2Stitch permission to use this material freely in the pursuit of the design.
Gift Vouchers
Photos2Stitch gift vouchers are valid for a period of 36 months from the date of activation following which they expire automatically. A gift voucher cannot be used after the expiry date and any remaining balance will be removed and the voucher will become invalid and no longer available for use. We have no obligation to remind or inform customers of a gift voucher’s expiry and it is the customer’s sole responsibility to ensure that any balance is used in full prior to expiry. Gift vouchers cannot be exchanged for cash.
Complaints
We aim to deal with any complaints in a fair and timely manner. Any complaints should be addressed in writing to the company at the published address or via the website contact form.
General
These Terms and Conditions supersede any previous Terms and Conditions distributed in any form. Photos2Stitch reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice. The placement of an order for design and/or any other services offered by Photos2Stitch, by email, verbally or in writing, is deemed to be acceptance of these Terms and Conditions, which are freely available at www.photos2stitch.co.uk.
